Why SDS Is Mandatory in Chile

The legal basis for the SDS in Chile is Supreme Decree No. 57/2019, which aligns with the UN GHS (7th Revised Edition), with specific exceptions and building block omissions.

  1. GHS Mandatory Implementation: Decree 57/2019 mandates the use of GHS for the classification, labeling, and SDS preparation for hazardous substances and mixtures sold or used in Chile.

  2. Mandatory SDS Format: The SDS requirements are outlined in Title V of Decree 57/2019 and the national standard NCh 2245:2021 (Safety Data Sheet for chemical products). The SDS must strictly follow the 16-section GHS format.

  3. Chemical Notification (Chile REACH): The regulation includes a notification system for hazardous chemicals. Manufacturers and importers of substances and mixtures containing hazardous substances must notify the government when volumes are $\geq 1$ ton per annum to the environmental authority via the Single Window of the Environmental Authority portal. A GHS-compliant SDS (in Spanish) is a mandatory attachment for this notification.

  4. Language Requirement: The SDS must be supplied entirely in Spanish (Español), the official language of Chile.

  5. Competent Authority: GHS implementation and classification are overseen by the Ministry of Health (MINSAL), while the notification system is jointly developed with the Ministry of the Environment (MMA).
