Costa Rica has a mandatory and established chemical safety framework based on the Globally Harmonized System (GHS), driven by the Ministry of Health (Ministerio de Salud). Why SDS Is Mandatory in Costa Rica

The legal requirement for providing safety documentation is mandatory and governed by a set of technical regulations:

  1. GHS Mandatory Implementation: Costa Rica adopted the 6th Revised Edition of the UN GHS through two key Executive Decrees and their corresponding Technical Regulations (RTCRs):

    • RTCR 478:2015 (Mandatory since May 2018): Governs the classification and the preparation of the SDS for hazardous chemical products.

    • RTCR 481:2015 (Mandatory since December 2022): Governs labeling requirements for hazardous chemical products.

  2. Mandatory Registration: All hazardous chemicals manufactured, imported, stored, distributed, supplied, sold, or used within Costa Rica must be previously registered with the Ministry of Health. A GHS-compliant SDS is a mandatory requirement for this registration process.

  3. Language Requirement: The SDS must be prepared entirely in Spanish (Español), the official language, for mandatory submission and circulation in the local market.

  4. SDS Format: Annex 1 of RTCR 478:2015 governs the preparation of the SDS. The content and format must follow the 16-section SDS format outlined in Annex 4 of the UN GHS Rev. 6.

A compliant SDS for Costa Rica must be:
