Key SDS Compliance Mandates in South Africa

1. Format and GHS System

  • Mandatory Format: The SDS must be a complete 16-Section GHS document as per Regulation 14A of the HCA Regulations, which references the structure and content of the South African National Standard (SANS) 11014:2010 (Safety Data Sheet for Chemical Products).

  • GHS Revision: South Africa currently aligns with UN GHS, Revision 8 via the HCA Regulations of 2021 (Regulation 14A). The DEL has plans to implement GHS Revision 10 by July 2025.

    • Classification: Manufacturers and importers must classify the chemical agent before manufacture or import, using the hazard classes and categories adopted by the GHS Rev. 8 standard.

  • Mandatory Disclosure: The identity and proportion of any ingredient that causes the correct GHS classification must be disclosed in Section 3.

2. Language Requirement

  • Primary Language: The SDS must be provided in English.

  • Additional Language: The label has an explicit requirement for English & Regional languages. While this rule is primarily aimed at labeling, it's best practice to ensure key safety information is accessible, though the full SDS in English is acceptable for regulatory submission.

3. Regulatory and Documentation Focus

  • Occupational Exposure Limits (OELs): Section 8 (Exposure Controls/Personal Protection) must list the relevant Occupational Exposure Limits (OELs) for hazardous chemical agents (HCAs). These limits are set by the Minister and listed in the Annexures of the HCA Regulations (e.g., Table 1 and 2 of Annexure 1).

  • Emergency Contact: The SDS (Section 1) must include South African emergency contact information that is available outside of working hours (i.e., a 24-hour response number). The overseas supplier's contact information may also be included.

  • Disposal: The SDS must include relevant guidance on the disposal of the HCA in accordance with local regulations (Section 13), aligning with South Africa's strict environmental laws.

  • Applicability: These regulations apply to all manufacturers, importers, suppliers, retailers, and employers of HCAs intended for use in a workplace.
