Ukraine is undergoing a major regulatory transformation to align its chemical management framework with the European Union (EU). This includes adopting its own versions of the REACH and CLP regulations, known as UA REACH and UA CLP. Compliance with these new regulations is mandatory for placing chemical products on the Ukrainian market.

Why SDS Is Mandatory in Ukraine (UA REACH/CLP Framework)

The legal requirement for a Safety Data Sheet (SDS) is established by the Law "On Ensuring Chemical Safety and Management of Chemical Products" (effective June 29, 2024) and subsequent technical regulations:

  1. UA REACH (Technical Regulation on the Safety of Chemical Products): Officially effective January 26, 2025, this regulation mandates the State Registration of chemical substances manufactured, imported, or placed on the market in quantities of one tonne or more per year. The SDS (or Extended SDS) is a mandatory document for this registration process, similar to the EU model.

  2. UA CLP (Technical Regulation on the Classification, Labelling, and Packaging of Chemical Products): Effective November 15, 2024, this regulation aligns Ukraine's hazard communication rules with the UN GHS and EU CLP Regulation (EC No 1272/2008). The SDS must be entirely consistent with the UA CLP classification and labeling requirements.

  3. Language Requirement: The SDS (and Extended SDS/Exposure Scenarios, when required) must be prepared in the Ukrainian language for mandatory submission and circulation in the local market.

  4. Workplace Safety: Ukraine's ratification of ILO Convention No. 170 (Chemicals Convention, 1990) further reinforces the legal obligation for employers to provide robust safety information (the SDS) to workers.

A compliant SDS for Ukraine must be:

  • Format: The mandatory 16-section SDS format, adhering to the structure and content requirements specified in the UA REACH regulation, which is based on REACH Annex II (EU Regulation 2020/878).

  • Language Specific: Written entirely in the Ukrainian language.

  • Content: Must include GHS classification consistent with UA CLP, and, for hazardous mixtures, readiness for potential Poison Centre Notification (PCN) requirements (though specific UFI/PCN deadlines are still being established).

The transition period for UA REACH began January 26, 2025. Registration deadlines are staggered based on annual tonnage and hazard profile:
